1. Introduction & Company Details
These Terms & Conditions ("Terms") govern your use of the CampHub platform ("Platform"), operated by Kinnd Co Pty Ltd trading as Camp Hub AU/NZ ("we", "us", "our"). Our Australian Business Number (ABN) is 66 684 718 269. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Definitions
"Operator" means a person or entity that lists a caravan park, campsite, or accommodation on the Platform."Guest" means a person who books or enquires about a listing through the Platform."Campz" means private land camping sites listed on the Platform."Experience" means tours, workshops, or activities offered through the Platform."Marketplace" means the section of the Platform where users can buy and sell camping and travel-related goods.
3. Acceptance of Terms
By creating an account, listing a site, booking a stay, purchasing an experience, or using the Marketplace on CampHub, you agree to these Terms. If you are using the Platform on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.
4. Eligibility
You must be at least 18 years old to create an account, list a property, or make a booking. Users under 18 may browse the Platform but must not transact without parental or guardian consent.
5. Listings — Caravan Parks & Campz
Operators are solely responsible for the accuracy and completeness of their listings, including descriptions, photos, pricing, availability, amenities, house rules, and cancellation policies. CampHub reserves the right to remove, edit, or unpublish listings that breach these Terms, misrepresent the property, receive sustained complaints, or otherwise harm the integrity of the Platform. Operators must ensure they have the legal right to offer the accommodation described in their listing.
6. Payment Terms — 15% Booking Fee
By listing with CampHub, Operators agree to a flat 15% commission on every booking made through the Platform. This fee covers payment processing, customer support, marketing, and platform maintenance. Payouts are settled to the Operator's nominated bank account after the fee is deducted and the guest's stay has commenced or as otherwise agreed in writing. CampHub is not responsible for delays caused by incorrect banking details provided by the Operator.
7. Promotions — Featured, Spotlight & Top of Search
Paid promotion tiers are billed monthly in advance and run for the period purchased. Promotions are non-refundable once active but may be cancelled at any time to prevent renewal. CampHub reserves the right to pause or remove a promotion that breaches platform rules or receives complaints. Promotion placement does not guarantee a specific volume of bookings or revenue.
8. Bookings, Refunds & Cancellations
Booking refunds follow each Operator's stated cancellation policy, which must be clearly displayed on the listing. Where no policy is shown, full refunds apply if the guest cancels 7 or more days before the scheduled check-in date. CampHub's 15% platform fee is refunded to the guest only when the full booking amount is refunded. No-shows and cancellations made after the cut-off date are generally non-refundable unless otherwise agreed by the Operator or required by applicable consumer law.
9. Marketplace & Experiences
Buyers and sellers in the Marketplace and Experience sections transact directly via CampHub. Sellers warrant they have the legal right to sell listed items or services, and that all descriptions, photos, and pricing are accurate. CampHub is not a party to individual Marketplace or Experience transactions but may mediate disputes at our discretion. All sellers must comply with applicable Australian and New Zealand consumer law.
10. User Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account or any other breach of security. CampHub will not be liable for any loss or damage arising from your failure to comply with this section.
11. Conduct & Safety
Users must treat hosts, guests, staff, and other community members with respect at all times. Harassment, discrimination, hate speech, fraud, unsafe behaviour, or the sharing of illegal content will result in immediate account suspension and may be reported to relevant authorities. We reserve the right to remove content or suspend accounts without notice for behaviour that violates these standards.
12. Content, Reviews & Intellectual Property
You retain ownership of content you upload to the Platform (photos, videos, reviews, descriptions). By uploading content, you grant CampHub a worldwide, royalty-free, non-exclusive licence to display, modify, and distribute that content on the Platform and in marketing materials. Reviews must reflect genuine, first-hand experience. Fake, paid, incentivised, or retaliatory reviews will be removed, and repeat offenders may have their account suspended. All CampHub branding, logos, software, and platform design are our intellectual property and may not be used without written permission.
13. Privacy & Data
Your use of the Platform is also governed by our Privacy Policy. We collect, use, and store personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Privacy Act 2020 (NZ) where applicable.
14. Liability & Disclaimers
CampHub provides the Platform on an "as is" and "as available" basis. To the fullest extent permitted by law, CampHub excludes all warranties, representations, and conditions not expressly stated in these Terms. CampHub is not liable for loss, damage, injury, or expense arising from bookings, stays, marketplace transactions, experiences, or interactions between users. Our total liability to you for any claim arising from your use of the Platform is limited to the amount you paid to CampHub in the 12 months preceding the claim, or AUD $100, whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable consumer protection law.
15. Indemnity
You agree to indemnify and hold harmless Kinnd Co Pty Ltd, CampHub AU/NZ, and their directors, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any third-party right; or (d) any content you upload or share through the Platform.
16. Termination & Suspension
CampHub may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, or is otherwise unlawful. You may close your account at any time by contacting us. Upon termination, all licences granted by you to CampHub will survive, and any accrued payment obligations will remain due.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and the federal laws of Australia applicable therein. Any disputes arising from these Terms or your use of the Platform will be resolved in the courts of New South Wales. If you are based in New Zealand, nothing in this clause limits your rights under the New Zealand Consumer Guarantees Act 1993.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. Where material changes affect Operators, we may require re-acceptance of the new version before paid listings can continue.
